Planning and development of territories in Ukraine: requirements for the outside form of multi-apartment building

In this article are researched the peculiarities of legal regulation of planning and development of territories in Ukraine, in particular, multi-apartment buildings. The legislation for the presence of requirements to the outside form of multi-apartment buildings are analysing. Gaps in the legal regulation are identified and ways to improve the process of multi-apartment development in Ukraine are suggested. It is determined that that the legal regulation of construction in Ukraine is represented by a large number of legal acts which regulate the relations between participants arising in the course of construction, and also regulate the process of construction by business entities. The concepts of «urban planning documentation» and «project documentation» are distinguished both by their legal status and functional purpose. Unlike urban planning documentation, project documentation is not an act of a local self-government body in accordance with Article 59 of the Law of Ukraine «On Local Self-Government» and is developed for each specific construction object, taking into account the requirements of urban planning documentation and initial data and in compliance with the requirements of the law, building codes and regulations. It has been determined that neither the provisions of SСN B.2.2-12:2019 «Planning and Development of Territories» and SСN B.2.2-15:2019 «Residential Buildings. Basic Provisions» and other applicable laws of Ukraine do not establish any requirements for the outside form of multi-apartment buildings. Regulatory legal acts establish requirements, for example, on the number of storeys and density of multi-apartment buildings, permissible distances between the facades of multi-apartment buildings, the maximum parameters of land development when placing an apartment building, etc. Based on the analysis of the current legislation, it has been considered that the construction customer may determine, at its own discretion, the features of the outside form of the apartment building, which may be specified in the design assignment or determined as a separate task for the architect - to create the outside form of the apartment building. It is proposed to to change the SСN B.2.2-12:2019 «Planning and Development of Territories» and to establish requirements for construction customers to comply with the same outside form for multi-apartment buildings, at least for at least one microdistrict, i.e. a block or a group of blocks.
