Human rights in the field of corruption prevention: problems of implementation and prospects for development

The article examines the relationship between human rights and corruption in modern society. The dual nature of this relationship is analyzed: on the one hand, corrupt actions directly violate fundamental human rights, limiting equal access to public services, fair justice and economic opportunities; on the other hand, effective fight against corruption is impossible without respect and protection of human rights. The legal status of a person in Ukraine in the context of anti-corruption activities and its legislative consolidation are considered. The author analyzes international documents on ensuring the rights of persons who have suffered from corrupt actions, in particular, articles of the UN Convention against Corruption, relating to compensation for damages, protection of victims and their right to access to justice. The main factors that determine the current state of the implementation of citizens’ rights and freedoms in the field of preventing and combating corruption in Ukraine are identified and characterized: low activity of citizens due to an insufficient level of legal culture; ineffectiveness of self-organization institutions; lack of a proper institution of accountability of officials; limited participation of the public in the law-making process; insufficient legal education of citizens; inadequate level of independence of the press; low material support of civil servants. Based on the analysis, it was established that despite the developed national legislative framework and ratification of international documents, mechanisms for ensuring citizens’ rights in the field of combating corruption are at the initial stage of formation. It is substantiated that effective counteraction to corruption is possible only with a comprehensive approach, which includes strengthening the transparency of government through the development of civil society, the formation of anti-corruption awareness, the creation of a system of social guarantees for civil servants and stimulating the development of citizens’ rights and freedoms in the field of preventing corruption. Particular attention is paid to the role of independent media and public organizations in combating corruption and protecting the rights of persons affected by corruption.
