NOVAS APLICAÇÕES DA LEI MARIA DA PENHA: STALKING E ASSÉDIO ONLINE CONTRA AS MULHERES

This article aims to analyze the new applications of the Maria da Penha Law in the face of the growing phenomenon of stalking and online harassment against women, contextualizing how these practices are configured as contemporary forms of genderbased violence, especially in the digital environment. To this end, the study presents a historical and legal overview of violence against women, the evolution of the concept of stalking, and existing legal gaps, seeking to integrate frameworks such as Brazil’s Internet Civil Rights Framework (Marco Civil da Internet) and the recent criminalization of stalking within the protective scope of the Maria da Penha Law. The methodology used is qualitative and bibliographic, based on the analysis of legislation, specialized legal doctrine, and international documents such as the Convention on the Elimination of All Forms of Discrimination against Women (CEDAW). Thus, it is expected to demonstrate how the recognition of these practices expands the scope of protective measures and highlights the need for specific public policies to ensure effectiveness in combating online violence. Therefore, this research intends to contribute to the legal and social debate on the comprehensive protection of women, suggesting paths to make legal responses more adequate to the challenges posed by new technologies and the virtualization of social interactions.
