Ethical and Legal Regulation of Pathomorphological Investigations in Phthisiopneumology: Limits of Patient Consent

The article discusses the ethical and legal issues surrounding the use of biopsy material in phthisiopneumology without patient consent, emphasizing the need to protect patient rights in pathomorphological investigations crucial for diagnosing lung diseases. The analysis of scientific literature, legal acts and ethical norms was carried out, using international databases. Methods of content analysis and comparative-legal approach were applied. The results of the study demonstrated that the lack of patient consent generates ethical dilemmas, especially in emergency situations. The implementation of the dynamic consent model will allow patients to control the use of their biological materials and will increase trust in the medical research.
