Autoría mediata por control de la voluntad en aparatos organizados de poder y su aplicación en el derecho penal peruano

The paper deals with indirect perpetration through control over the will of others within organized structures of power and its application in Peruvian criminal law, which has been infringing upon the principle of legality. This occurs through individuals who are held responsible as direct perpetrators of the act, and to that end, the concept of organizational wrongdoing is created, allowing for the indirect attribution of responsibility to the person behind the act. This involves the reasoning based on the so-called structural organization factor and the use of criteria for assigning criminal liability.
