Adequacy of Fair Trial Guarantees in Palestine's Arbitration Legislation

Arbitration is an exceptional way to settle disputes between parties outside the regular judiciary. The reason for resorting to it is often the parties’ desire to expedite the resolution of their dispute and/or for the purpose of preserving the secrets of their relationship with each other. When reviewing the legislation regulating arbitration in most countries of the world, it is found that they all seek, from a procedural standpoint, to create guarantees that ultimately aim to reach a fair trial by establishing lofty principles not permissible to violate or exceed the obligation to observe it under any circumstances, such as the principle of confrontation, fair treatment of the parties to the dispute, and the impartiality of the arbitrator, in addition to detailed procedural rules regulating the stages of resolving the dispute according to the path outlined by the legislator. Arbitration legislation in Palestine is not different from what was mentioned above. Aim: is to examine the adequacy of arbitration legislation in Palestine in providing fair trial guarantees. Method: Descriptive analytical method was adopted. Results: Results indicated that the arbitration legislation in Palestine contains some of legal provisions necessary to ensure fair litigation procedures. However, it lacks many of the necessary requirements for this. Results highlighted how this deficiency can be addressed by resorting to the relevant regulatory procedural legislation. Conclusion: According to results, it is recommended to reviewing and amending the arbitration legislation in force in Palestine, or enacting alternative legislation to ensure that the shortcomings, weaknesses, and defects which have been referred to are addressed, particularly with regard to the requirement that these legislations include a clear and complete regulation of the basic principles of litigation and general procedural provisions, in addition to granting the arbitrator the authority to complete any deficiency therein by referring to the Evidence Law and the Civil and Commercial Procedure Code.
