DARK KITCHEN, DELIVERY E O DIREITO DA CONCORRÊNCIA NO BRASIL: DESAFIOS REGULATÓRIOS E ESTRUTURAS DE MERCADO
The rise of dark kitchens — industrial kitchens exclusively designed for delivery — has profoundly transformed the dynamics of the food service market in Brazil, driven by digital delivery platforms. This paper analyzes, from the perspective of Competition Law, the structural and competitive impacts of this business model, addressing issues such as market power, platform verticalization, exclusivity clauses, and potentially anticompetitive practices. Through a law-and-economics approach, it examines the role of the Brazilian Competition Authority (CADE) and the regulatory challenges posed by new forms of concentration and informational asymmetry.
