LEGAL PRINCIPLES OF VOLUNTARY HEALTH INSURANCE IN UKRAINE

The scientific article is devoted to establishing the features of the legal regulation of voluntary health insurance. It examines the legislative acts that establish the legal principles for providing financial services, as well as commercial and social insurance. The paper analyzes the subordinate legislation that establishes the legal status of insurance companies and the requirements for licensing insurers. It clarifies the opinions of scientists in the fields of law, economics, and medicine who studied the features of health insurance. The definition of health insurance is proposed as a type of civil contract of personal commercial insurance, which is concluded between a citizen and an insurance company to pay for additional medical services not funded by the state program of financial guarantees of medical care for the population. The features of the legal regulation of health insurance are determined. It is argued that the legislative acts establish general requirements for the conclusion of insurance contracts but do not provide special conditions for voluntary health insurance contracts. Attention is drawn to the fact that an insurance company that intends to provide health insurance services must obtain a license to carry out insurance business activities in such classes of insurance as health insurance and accident insurance. It is concluded that to provide health insurance an insurance company should develop several internal regulatory legal acts: general conditions of such an insurance product as voluntary health insurance, rules for providing financial services for health insurance, rules for considering applications from consumers of financial services, a methodology for calculating insurance tariffs for health insurance, and others. Separate licensing conditions for health insurance must be developed and approved to improve the legal regulation of voluntary health insurance.
