FEATURES OF PREPARATION AND CONDUCTING IDENTIFICATION USING PHOTOGRAPHS DURING THE INVESTIGATION OF SELF-INTERESTED CRIMES UNDER THE LEGAL REGIME OF MARTIAL LAW

The article examines the features of preparing and conducting identification using photographs during the investigation of self-interested crimes under the legal regime of martial law. It is noted that identification using photographs is permissible only in cases where there is no need to observe the person to be identified in motion (i.e., based on functional characteristics such as gait, gestures, facial expressions, voice, speech, articulation, and manner of behavior). This necessity should be clarified by the investigator during the questioning of the identifying person. If such a necessity exists, identification may be conducted using video recordings. The article outlines procedural and forensic (technical) requirements for images (photographs) presented for identification. It is recommended that each selected person (stand-in) be photographed separately against the same background, using the same camera, under the same lighting conditions, and from the same distance as the person to be identified. All photographs should be adjusted to the same scale. A list and sequence of questions to be asked to the identifying person are proposed. This approach ensures the collection and documentation in the protocol of detailed responses regarding the date, time, place, and circumstances under which the identifying person saw the individual being identified, as well as the specific external features on which the identification is based. A promising high-tech method for conducting this investigative (search) action, as a logical development and modern alternative to identification using photographs, is the use of 3D images of live individuals for identification. It is emphasized that proper preparation and execution of this type of identification are possible only with the involvement of a qualified specialist in forensic photography and identification based on external features.
