ASAS IJBARI DALAM HUKUM WARIS ISLAM DAN IMPLIKASINYA DALAM PENOLAKAN WARIS

ABSTRACT The principle of ijbari is one of the fundamental principles in Islamic inheritance law. That is, the transfer of property from the testator to his heirs is automatically according to Allah's decree without depending on the will of the testator or the heirs. The application of this principle is that the heirs inevitably have to accept, although in practice there are disputes that trigger the heirs to reject inheritance. This research seeks to answer the question of whether the legal implications of refusal of inheritance are related to the principle of ijbari. This research is qualitative with a literature study. The data sources used are primary and secondary literature in the form of classical and contemporary fiqh books, laws and regulations, fatwas and relevant journals. Data collection techniques with documentation and interviews from primary sources. Data analysis methods include data collection, data reduction, data presentation and conclusion of research results. The results show that the inheritance property transfers automatically because of the ijbari principle. Implications for the rejection of inheritance, heirs can refuse inheritance with takharuj and tashaluh, but are still bound by the consequences of inheritance. Yaitu peralihan harta dari pewaris kepada ahli warisnya adalah secara otomatis sesuai ketetapan Allah tanpa digantungkan kepada kehendak pewaris maupun ahli waris. Penerapan asas ini bahwa ahli waris mau tidak mau harus menerima, meskipun dalam prakteknya terdapat sengketa yang memicu ahli waris melakukan penolakan waris. Penelitian ini berupaya menjawab pertanyaan apakah implikasi hukum dalam penolakan waris berkaitan dengan asas ijbari. Penelitian ini adalah kualitatif dengan studi kepustakaan. Sumber data yang digunakan berupa literatur yang bersifat primer dan sekunder berupa kitab fiqh klasik dan kontemporer, peraturan perundang-undangan, fatwa dan jurnal yang relevan. Teknik pengumpulan data dengan dokumentasi dan wawancara dari sumber primer. Metode analisis data meliputi pengumpulan data, reduksi data, penyajian data dan penyimpulan hasil penelitian. Hasil penelitian menunjukkan bahwa harta waris berpindah secara otomatis karena asas ijbari. Implikasi terhadap penolakan waris, ahli waris dapat menolak waris dengan takharuj dan tashaluh, namun masih terikat dengan konsekuensi waris. Kata Kunci: Asas Ijbari, Waris Islam, Penolakan Waris
