Current problems of the constitutional judiciary in Bosnia and Herzegovina
Contemporary constitutionalism in Bosnia and Herzegovina, which was created by the Dayton Agreement, has existed for practically 30 years. However, an important role in strengthening and establishing the BiH Constitution is played by the bodies of the constitutional judiciary. To this day, the Constitutional Courts of this state face serious problems that lead to conflict at the state level. The task of this paper is to show the key negative aspects that have been formed in the process of development of the bodies of the constitutional judiciary, as well as to propose possible ways of resolving them, through the analysis of current legislation and theoretical views of lawyers.
