Research on the Enforcement Mechanism of Settlement Agreements in China under the Singapore Convention on Mediation

The Singapore Convention on Mediation establishes a cross-border direct enforcement mechanism for international settlement agreements, advancing international commercial dispute resolution. However, the Singapore Convention on Mediation faces challenges in aligning with China’s domestic legal framework due to significant gaps between its direct enforcement regime and China’s domestic mediation enforcement mechanisms, insufficient commercial mediation legislation, and inadequate legal regulations against fraudulent mediation. China, which has long prioritized mediation as a key dispute resolution approach, should proactively explore institutional alignment with the Singapore Convention on Mediation to enhance its international commercial dispute resolution system and promote international trade and economic development.
