知识产权融资租赁是将知识产权作为融资标的，通过租赁方式为企业提供融资支持的创新模式。本文首先回顾了知识产权融资租赁的发展现状，分析了其在我国的法律规制，并探讨了其在市场中的应用。文章进一步探讨了知识产权融资租赁的法律属性，包括其适格性与交易模式，指出其在法律框架内具备可行性。然后，文章分析了知识产权融资租赁面临的主要法律困境，如权利保障风险、价值评估难题及市场交易局限，并提出相应的改进措施。最后，本文提出对知识产权融资租赁法律制度的完善建议，旨在通过优化司法解释、规范市场交易以及细化出租人权利，推动我国知识产权融资租赁市场的发展。Intellectual property financing leasing represents an innovative financing model that utilizes intellectual property rights as collateral to provide enterprises with financial support through leasing arrangements. This paper systematically examines the developmental trajectory of intellectual property financing leasing, analyzes its regulatory framework within China’s legal system, and explores its practical applications in the market. The study further investigates the legal attributes of intellectual property financing leasing, including its eligibility criteria and transactional models, demonstrating its feasibility within the existing legal framework. Subsequently, the paper identifies and analyzes the primary legal challenges confronting intellectual property financing leasing, such as risks associated with rights protection, difficulties in value assessment, and limitations in market transactions, while proposing corresponding improvement strategies. Finally, the study offers recommendations for enhancing the legal framework governing intellectual property financing leasing, aiming to promote the development of China’s intellectual property financing leasing market through the optimization of judicial interpretations, standardization of market transactions, and refinement of lessors’ rights.
