IMPACTOS DA ECONOMIA GIG NAS RELAÇÕES DE TRABALHO: ANÁLISE DAS NOVAS FORMAS DE TRABALHO MEDIADAS POR PLATAFORMAS DIGITAIS E OS DESAFIOS JURÍDICOS PARA A REGULAÇÃO DESSES TRABALHADORES
This scientific article addresses the legal challenges in regulating work relationships mediated by digital platforms in the gig economy, focusing on adapting traditional labor laws to ensure social protection and workers’ rights in this new scenario. The gig economy, characterized by temporary jobs facilitated through apps such as Uber, iFood, and Rappi, has introduced new dynamics to the labor market, sparking debates about the legal nature of these relationships and the social protection of the workers involved. The study analyzes Brazilian jurisprudence, highlighting divergent decisions regarding the recognition of employment relationships in these contexts. Furthermore, it examines international models, such as Spain’s, which implemented specific legislation for platform workers. The method used is qualitative, with bibliographic and jurisprudential analysis, to explore the particularities of this type of labor relationship. The research indicates that the lack of adequate regulation contributes to the precariousness of working conditions, suggesting that a hybrid legal framework could be a viable solution to balance flexibility and social protection. The study concludes that it is urgent to modernize the Brazilian legal framework to ensure legal security for both workers and platforms, without hindering innovation and economic development driven by this model.
