KRYTERIUM RODZINY W DEFINICJI GOSPODARSTWA RODZINNEGO – GŁOS W DYSKUSJI

<ns3:p>The article is devoted to the issue of family farming. The aim of the article is to characterize the criterion of the family nature of a family farm in Polish agricultural law. The author first referred to the existing definition of family farming, drawing attention to the voices of criticism of this concept in the agricultural law literature. The author stated that the current definition of this legal institution does not correspond to the purpose of its creation – protection of the family farm. Next, she proposed that when defining a family farm, we should follow the economic approach to the concept of a family farm, which in particular emphasizes relationships with the family (so-called family nature). In conclusion, the author emphasized the need to introduce the concept of family in a broad sense into the definition of a family farm. She also proposed introducing legal provisions aimed at ensuring the sustainability of the family farm, which would guarantee its protection. The originality of the article lies in the fact that for the first time in the literature it was proposed to follow the economic definition when creating a legal definition of the concept of a family farm. The article uses a critical analysis of literature.</ns3:p>
