POLÍAMOR E A POSSIBILIDADE DE RECONHECIMENTO LEGAL NAS RELAÇÕES AFETIVAS MÚLTIPLAS NO BRASIL
The present study is based on the general premise of analyzing the feasibility of the legal recognition of polyamory in Brazil, considering the need for legislative reforms and the social and legal implications of this possible inclusion. The research contextualizes the evolution of the concept of family in the Brazilian legal system, from the Federal Constitution of 1988 to the recognition of same-sex unions by the Supreme Federal Court (STF). It highlights that, despite these transformations, polyamory still lacks normative support and is often classified as concubinage, which prevents access to rights granted to stable unions and marriage. The methodology used is bibliographic, qualitative, and descriptive, relying on the analysis of doctrines, case law, and national and international legislation. The results indicate that the absence of a specific legal framework for polyamory generates legal uncertainty and unequal treatment among different family arrangements. It is also observed that progress in recognizing new family structures depends on both the evolution of legal thought and social acceptance. Thus, the study concludes that although significant barriers still exist, increasing debate and visibility on the topic may drive future legislative and jurisprudential changes that ensure greater protection and legal security for multiple affective relationships.
