PRINCIPLES OF ESTABLISHING LAND USE RESTRICTIONS
One of the most important mechanisms for ensuring efficient and sustainable use of land resources is land use planning. One of the components of land use planning is the division of the territory into different zones with certain regulations and restrictions on land use. Given the development of information technology and the constant transformation of regulatory frameworks, the technologies for setting restrictions are subject to change. Despite the importance of restrictions, there are different methods that may not be consistent with each other. The absence of a unified approach and clear recommendations for the formation of land use restrictions can lead to inefficient use of land resources, violation of the rights of owners/users, environmental imbalance of territories, and delays in project implementation. Ukrainian legislation on land use restrictions provides for the regulation of various aspects of land management and urban development. The main legislative acts defining land use restrictions are: The Land Code, the Water Code, the Laws of Ukraine: “On Land Protection, On Regulation of Urban Development, On the Nature Reserve Fund of Ukraine, On Protection of Cultural Heritage. The article analyzes the existing principles of land legislation, land management, spatial development, environmental protection, cadastral systems and their systematization to establish restrictions on land use. The paper examines publications by foreign authors that define the principles of land management and land use planning and systematize the list of principles: balance and sustainability; responsibility and efficiency; respect; participation; justice and equality; transparency and accountability. Based on the analysis, the principles for the formation of restrictions on land use are systematized. Decision-making processes on land management are clear, transparent, consistent and understandable.
