Kajian Penggunaan Dewan Sengketa pada Proyek Konstruksi di Indonesia (Studi Kasus: Proyek MRT Jakarta Fase 2A)

Construction projects often involve complex interactions that can lead to inevitable disputes requiring prompt resolution. Dispute boards offer a potential alternative for both preventing and resolving such conflicts. This study aims to identify the strengths, weaknesses, opportunities, threats, and appropriate strategies for implementing dispute boards in Indonesian construction projects, using the MRT Jakarta Phase 2A Project as a case study. A qualitative descriptive approach is employed, utilizing the Internal Factor Analysis Summary (IFAS) to assess strengths and weaknesses, and the External Factor Analysis Summary (EFAS) to explore opportunities and threats. These analyses are integrated into a SWOT framework to formulate relevant strategies. The findings suggest that standing dispute boards can help prevent dispute escalation and enhance resolution effectiveness. However, their success depends on mutual trust among stakeholders and the relatively high operational costs. While dispute boards can meet the need for effective conflict resolution during construction, their broader adoption in Indonesia is hindered by limited awareness of their benefits and a shortage of qualified board members. To support their implementation, recommended strategies include the establishment of clear regulations and ensuring that all parties are granted equal rights to initiate the use of dispute boards.
