Hüquqi aktların qanunvericilik aktlarına uyğunluğuna dair Azərbaycan Respublikası Konstitusiya Məhkəməsinin normativ xarakterli aktları

In this article is noted that the effectiveness of the activities of the Constitutional Court of the Republic of Azerbaijan is reflected in the legal acts adopted by it. Unlike acts of other judicial bodies, decisions of the Constitutional Court may have a normative character. In this regard are considered the features of normative acts adopted by this court. It is noted that the acts of the Constitutional Court of our country play an important role in the development of public relations. The acts of normative character adopted by the national constitutional court are not officially considered “secondary sources of law”. In the article, the author points out that the result of the consideration of the case on the constitutionality of a normative legal act by the Constitutional Court of the Republic of Azerbaijan is the recognition of the conformity or contradiction of the normative legal act with the Constitution of the country. If the relevant act is recognized as unconstitutional, then certain legal consequences arise: acts recognized as unconstitutional are recognized as invalid; international treaties of the Republic of Azerbaijan that have not entered into force and are recognized as contradicting the Constitution must not enter into force and are not subject to application. Decisions of courts and other bodies based on the relevant acts or their individual provisions, recognized as unconstitutional by the decision of the Constitutional Court of the Republic of Azerbaijan, must not be sent for execution and are subject to revision in cases determined by law. The article also emphasizes that the legal positions formulated in the decisions of the body of constitutional justice serve to establish a unified law enforcement practice, eliminate gaps and contradictions in legal regulation.
