Interpreting rights outlined in regional and international human rights frameworks is essential for advancing environmental protection. These rights offer powerful mechanisms to support environmental justice. This paper examines two main issues: the extent to which courts are open to broadly interpreting rights under the Conventions to safeguard the environment. By addressing these questions, the study highlights the role of legal frameworks in fostering a rights-based approach to environmental safeguarding. The second explores whether courts are inclined to expand traditional human rights principles. This paper examines judicial approaches through relevant case law, offering a critical evaluation of the rights-based framework for environmental protection.
