The evolution of the institution of the prefect in Romania in the context of statutory transformation
In this article, an important topic for public administration is addressed, that of the institution of the prefect from the perspective of its evolution at different historical stages. The importance of the institution of the prefect in the national public administration system is argued from the perspective of the good functioning of the central and local administrative system. We formulate opinions through which we express our reasoned disagreement with this shift, referring to European models and especially to the example of France. The prefect’s quality as a politician does not automatically lead to a politician’s influence in the exercise of his duties, his duties are not political. A reform of the institution of the representative of the government in the territory also implies the presence of the capacity to improve the performance of the administration. The current regulation of the status of the prefect in his capacity as a public official corresponds to the governmental appointment procedures, perhaps even to the exercise of the powers established by the legislator for the prefect, but not all. The positioning of the prefect-politician in relation to the local executive and deliberative public authorities. The function of representation ensures, on behalf of the Government, the representation of the central executive at the local level. The evolution of the legal regulation of the prefect in Romania in the context of the statutory transformation has been completed, at present, by clear rules that satisfy with certainty the main vector to be achieved in the administration, whose owner is indisputably the citizen.
