From Picture Product to Video Product: Taking Sora as an Example to Explore the Originality Identification of Artificial Intelligence-Generated Content

The rise of AIGC challenges traditional standards for legally and ethically identifying originality. AIGC can independently "create" content with external form characteristics of works, but tools like Sora reduce human involvement from being dominant to auxiliary. As a result, existing standards for evaluating the originality of image products may need to be adapted. Based on this, we propose a criterion of "objective first, subjective second." This means we should first examine the external form of the work from the perspective of the result, and then analyze whether the work embodies the author's unique creative style and emotion from the perspective of the process. At the same time, we should adhere to the method of specific case analysis and respect the independence and uniqueness of each video.
