Analysis Oof Fiqh Siyasah Dusturiyah on the System Appointing the Capital Authority Head Based on Law Number 3 of 2022 Concerning the State Capital

The uniqueness of the Nusantara State Capital (IKN) has once again become a significant discourse in Indonesian state administration. Controversy arises when the governance of IKN, designed as an authority, is led by a head of authority whose position is equivalent to that of a ministry, appointed by the president, and without a Regional House of Representatives (DPRD) to oversee governance. This regulation is stipulated in Articles 5 (3) and (4) of Law No. 3 of 2022 concerning the State Capital. This study analyzes appointing the head of the IKN Authority based on the aforementioned law and to assess this appointment system through the lens of fiqh siyasah dusturiyah (constitutional political jurisprudence). Employing normative legal research, this study uses primary and secondary legal sources and relies on library research for data collection. The findings reveal, first, that the appointment of the IKN Authority Head, despite its challenges, is feasible under the relevant legal framework and the theory of asymmetric decentralization. Second, the appointment aligns with the Islamic constitutional concept of appointing a wali (governor) as outlined in fiqh siyasah dusturiyah.
