„G25“ und „G41“ – Arbeitsschutz versus Arbeitsrecht
“G25” and “G41” – occupational safety versus labor law Contrary to what might be expected, the discussions regarding the legality of aptitude tests have not completely calmed down. The Government has once again emphasised that the conduct of certain aptitude tests is not seen as a task of occupational health and safety. Employers also ask company doctors (sometimes through law firms) “what the results of the suitability test were”. The never-ending discussions about these issues make it worthwhile to take another look at the current legal situation. In the following, this will be done using the still commonly known “G25” and “G41”.
