Legal Regulation of Algorithmic Discrimination on E-Commerce Platforms in the Era of Big Data

With the advent of the big data era, algorithmic discrimination on e-commerce platforms mainly manifests itself in price discrimination, gender discrimination and information cocoon, whose technical roots lie in the accumulation of data bias and the black-box characteristics of algorithms, which not only infringes on consumers’ right to fair trade and right to know, but also exacerbates the chaos of the market order and inequality in the group. At the same time, the law is lagging behind, difficult to prove and cross-border regulation, which makes it difficult to solve the practical problems. Only by building a three-dimensional framework of “technical governance + institutional innovation + social co-management”, relying on multi-dimensional measures such as improving legislation, establishing a data cleanliness assessment mechanism, establishing joint and several liabilities for algorithm developers and data providers, and improving citizens’ education on algorithm literacy, can the real problem of algorithmic discrimination be solved systematically, balancing technological development and fairness and justice.
