The Ombudsman for Small and Medium-Sized Entrepreneurs’ obligation to pay the court fees – commentary on the order of the Supreme Administrative Court of 2 December 2024, II GPS 1/24

The commented order raises an issue of the court fees, which is important from the perspective of the work methodology of an administrative judge. The Supreme Administrative Court, despite its refusal to adopt an abstract resolution, held that the Ombudsman for Small and Medium-Sized Entrepreneurs is obliged to pay court fees. The author of the order does not share this view. He argues that the SAC had no grounds for refusing to adopt a resolution since the conditions for its issuance had been met. Furthermore, the author indicates that the position of the Court is mistakenly, because its ignore the systemic and other types of arguments.
