PERLUASAN KOMPETENSI PTUN PASCA BERLAKUNYA UNDANG-UNDANG CIPTA KERJA

This artikel discusses the absolute competence of the State Administrative Court in positive fictitious cases after the enactment of the Job Creation Law, and its impacts. The approach method used in this research is normative jurisdiction, analytical descriptive specifications. The data collection method used was literature study, the data was then analyzed using qualitative analysis methods. The results of the author's research conclude that the absolute competence of the State Administrative Court in fictitious cases is positive after the enactment of the Job Creation Law, PTUN no longer has the authority to grant legal approval and will be further regulated in a presidential regulation, but to date a presidential regulation has not been issued. The event had an impact on legal uncertainty, because people did not submit positive fictitious requests which were legally granted. And legal certainty is one of the conditions for law enforcement. If the authority for positive fictitious applications is no longer under the authority of the PTUN, then there will be legal decline because it will eliminate the power of the judiciary, and will strengthen the executive's power to adjudicate a case and result in the executive power acting arbitrarily in adjudicating positive fictitious applications.AbstrakArtikel ilmiah ini membahas tentang kompetensi absolut Pengadilan Tata Usaha Negara dalam perkara fiktif positif pasca berlakunya Undang-Undang Cipta Kerja, beserta dampaknya. Metode pendekatan yang dipergunakan dalam penelitian ini adalah yuridsi normatif, spesifikasi deskriptif analitis. Metode pengumpulan data yang digunakan adalah studi kepustakaan, data tersebut kemudian dianalisis dengan metode analisis kualitatif. Hasil dari penelitian penulis menyimpulkan bahwa Kompetensi absolut Pengadilan Tata Usaha Negara dalam perkara fiktif positif pasca berlakunya Undang-Undang Cipta Kerja, PTUN tidak lagi memiliki kewenangan mengabulkan secara hukum dan akan diatur lebih lanjut pada peraturan presiden, namun hingga saat ini peraturan presiden tidak dikeluarkan. Adanya peristiwa berdampak pada ketidakpastian hukum, karena masyarakat tidak mengajukan permohonan fiktif positif yang dikabulkan secara hukum. Dan kepastian hukum ini merupakan salah satu syarat untuk penegakan hukum. Kewenangan permohonan fiktif positif jika tidak lagi menjadi kewenangan PTUN, maka akan terjadinya kemunduran hukum karena telah menghilangkan kekuasaan yudikatif, dan akan memperkuat kekuasaan eksekutif untuk mengadili sebuah perkara dan mengakibatkan kekuasaan eksekutif bertindak sewenang-wenangnya dalam mengadili permohonan fiktif positif.
