Penal Mediation in Algerian Law: A Comparative Study with French Legislation
This study presents an overview of the concept of penal mediation, where the adoption of this system came in response to the urgent need arising from the increasing number of crimes. This surge has led to a rise in cases presented before the judiciary, resulting in a crisis within the criminal justice system.Under the pressure of this crisis, modern criminal policy has turned to penal mediation as one of the restorative justice models, following traditional punishment failure to combat criminal phenomena.Consequently, penal mediation has become part of the evolution of criminal procedures toward the realisation of criminal justice. Therefore, modern legislation has moved towards adopting this system, as demonstrated by the Algerian legislature.
