Hermenéutica, phrónesis y argumentación jurídica : una propuesta de reconducción del juicio jurídico desde el pensamiento de H.-G. Gadamer

In this paper we intend to establish some lines of reflection on the problem of the epistemological status of the legal sciences, based on the hermeneutical thought of H.-G. Gadamer, emphasizing the important role of phronesis as a model of hermeneutical exercise, to show how hermeneutics is an instrument for guiding legal argumentation, beyond a merely procedural techne, which has ended up obscuring in a certain sense the humanist vocation of legal knowledge. First, we propose a philological approach to judging and judgment; secondly, we propose a relationship between hermeneutics and phronesis in Gadamer’s thought; Finally, we propose some margins of phronetic hermeneutics to legal argumentation
