Nichtmenschliche Zurechnungssubjekte
The article challenges the traditional private law doctrine that exclusively attributes responsibility to human actors and advocates for a deanthropocentric framework of attribution and responsibility. It argues that private law constructs – such as persons, actions, legal capacity, attribution, and responsibility – are fundamentally social constructs that must evolve in response to shifting societal conditions. The emergence of non-human, artificially intelligent entities represents a transformative societal shift, necessitating innovative legal models for attributing responsibility to such entities. The proposed deanthropocentric model of responsibility is not merely a theoretical concept but can already be integrated into existing legal frameworks, offering a progressive reinterpretation of legal dogma.
