The Problems of Using Evidence in Criminal Proceedings: Boundaries of Admissibility

In the context of establishing a rule-of-law state, the issues of procedural guarantees in criminal proceedings become particularly relevant, as they are aimed at protecting human rights. The article analyzes existing problems related to the lack of clear criteria for the admissibility of evidence, which can lead to violations of the rights of suspects and defendants. It examines the risks of unlawful conviction or acquittal of guilty individuals. A hypothesis is proposed regarding the necessity of developing clear criteria for evaluating evidence. The conclusions of the article emphasize the need for legislative enshrinement of the concept of "admissibility of evidence", which could contribute to a more equitable criminal process.
