ХИЛИЙН ДЭГЛЭМИЙН ГЭРЭЭНИЙ ХЭРЭГЖИЛТ

According to the previous research purposes, methods and actions of illegal immigrantshave been changed during the period since 1990s when Mongolia has transited to market economy andcriminal felonies which are mostly connected to human trafficking, illegal sales of automobiles, cars, naturaland mineral resources, fur animals, valuable memorial items, herbal plants and drugs to and from abroad,organized contraband cases, mafia and secret groups of illegal trades and criminal cases (to enter to borderof Mongolia illegally, indicated in the Article Number 89 of Criminal Law and violence of border rule ofMongolia, indicated in the Article Number 90 of Criminal Law) are developed more day by day. On August09, 2007 Law of Criminal Procedure has been amended and changed that border emissary officer has beenomitted from the authority to conduct criminal procedure and it influenced to the condition oppositely. Dueto the above amendment of the Law right of a subject who works at the practical site to inspect order ruleviolence which arises in border site is closed. This influences to illegal immigrants and violators of border rulenot to be penalized and investigation procedure of criminal case is reducing. Therefore there is an inevita-ble urgent requirement which to provide the emissary officers of border with a right to register cases andconduct investigation activities.
