The legal nature of the remuneration due to foster parents, as well as other aspects of material support for foster families

The article examines the concepts of remuneration due to foster parents, monetary support for orphans and children left without parental care, full state support. An analysis of the legislation of the Russian Federation and its constituent entities was carried out in terms of establishing the remuneration due to foster parents, the composition and amount of funds for the maintenance of orphans and children left without parental care raised in foster families. As a result of the study, it was concluded that the remuneration due to foster parents is closer to the concept of wages as remuneration for labor, its size does not reach the minimum wage established in the constituent entities of the Russian Federation. The current level of monetary support for orphans and children left without parental care does not correspond to the established subsistence minimum in the regions, as a result of which the needs of these categories of minors in foster families are only partially met. Thus, at this stage, it is impossible to assert the full state support of these children if they are in the family of a guardian (trustee), a foster family.
