La razonabilidad del plazo de conducción de la investigación preliminar y el principio de legalidad. Ministerio Público, Lima – Perú

The objective of this document was to determine a deficiency in the Principle of Legality due to the absence of a reasonable period in preliminary investigations that violates Due Process. A basic, descriptive-interpretive research was carried out, from a qualitative approach. From the result, questions are determined regarding the reasonable period of time in the Preliminary Investigation according to the characteristics and complexity of each case, and that the Public Ministry presents shortcomings in the direction of said stage. In conclusion, determining a reasonable period of preliminary proceedings will make it possible to strengthen the investigation by the institutions in charge, in order to effectively fulfill their functions for the benefit of society.
