Analysis of the Legality of Administrative Punishments Set by Departmental Rules
To a certain extent, the administrative penalties set by departmental rules break through the status of executive legislation, and there are different understandings in the academic circles about the tension within the law and the “laws and administrative regulations that have not yet been formulated”. Based on the role of administrative penalties set by rules on the status quo of administrative management, this paper compares the administrative penalties set by departmental rules horizontally and vertically from the perspective of authorized legislation and analyzes the legitimacy of administrative penalties set by departmental rules from the perspective of “matter theory”, so as to achieve the unity of appropriate release and effective restriction of the legislative space of departmental rules.
