Research on the Criminal Responsibility Boundary and Judicial Practice of “Obscenity from a Distance”
With the development of the Internet, obscenity from a distance has become an increasingly rampant phenomenon of cybercrime, which is manifested in the behavior of inducing or coercing minors to chat naked, sending private photos, and even threatening them to further implement illegal demands. This kind of behavior is hidden and persistent, and it is easy to be imitated by others, which has profound social harm and needs to be regulated by criminal law. This paper will focus on the boundary of criminal responsibility of obscenity from a distance, and discuss the differences in judicial practice, aiming at providing a reference perspective for the definition of criminal responsibility and promoting the further improvement of criminal law regulation of “obscenity from a distance” to cope with the new trend of sexual assault on children promoted by information network technology.
