The Perplexing Reference of Islamic Law in the Egyptian Statutory and Constitutional Texts

Abstract This article assesses the role of Islamic law as an official source of legal rules in the Egyptian legal system. Despite the vague references to the general principles of Islamic law in both Egyptian civil law and Egyptian constitutions, senior courts developed the term of general principles of Islamic law, after the issuance of the Constitution of 2012, to encompass not only the common principles of Islamic law but also the rules of Islamic jurisprudence. These new developments equalise between the general principles of Islamic law and the rules of Islamic jurisprudence.
