Cárcere, necropolítica e maternidades subversivas:
The present study investigates the application of necropolitics in the Brazilian prison system, focusing on pregnant women. Drawing on theoretical frameworks of mass incarceration and the ruling on the State of Unconstitutional Affairs, the study explores how the State exerts power over life and death within prisons, creating a cruel selectivity that disproportionately affects marginalized bodies. It addresses the vulnerability faced by these women, highlighting the precarious medical care, unsanitary conditions, and structural neglect that endanger both the lives of pregnant women and their children. Using a legal-descriptive methodology and a review of secondary data, the article reveals the discrepancy between legal provisions and the reality within prisons, particularly regarding the protection and care of pregnant and lactating women. The aim is to demonstrate the human rights violations faced by this group, a result of selective punitive policies that exacerbate inequalities and precarious conditions in the prison system.
