Legal Practice and Challenges of Marine Environmental Protection Organizations in Public Interest Litigation
The issue of marine environmental degradation in China has become increasingly severe, drawing significant attention from all sectors of society. The role of marine environmental protection organizations in promoting marine environmental governance cannot be overlooked. In recent years, these organizations have played a significant role in protecting the marine environment and safeguarding public interests through public interest litigation. This paper focuses on the legal foundation of marine environmental public interest litigation, combining domestic and international typical cases to systematically analyze the role positioning, legal basis, and practical effectiveness of marine environmental protection organizations in public interest litigation. It also explores the institutional obstacles and resource limitations they face. The study finds that public interest litigation not only strengthens the enforcement of the environmental rule of law but also provides a legal pathway for public participation in marine environmental protection. However, issues such as the lack of autonomy in public interest litigation by environmental organizations and delays in accessing litigation information still constrain their effectiveness. Based on these findings, this paper proposes recommendations for improving legal systems, providing resource support, and enhancing public participation, aiming to offer theoretical support for the sustainable development of public interest litigation by marine environmental protection organizations.
