Administrative Contract in the Public Administration Process as a Form of Exercising Public Authority
At the modern stage, an important place in the system of forms of implementation of public administration is occupied by the institution of the administrative contract, which is intensively developing within the framework of the legislative and institutional framework of public and private partnership. Thus, in order to exercise public authority, the administrative body increasingly uses the administrative contract, which is in the form of a civil-legal contract concluded with a natural or legal person, as well as with another administrative body. The paper presents the features of the use of administrative contracts in various areas of public administration. In addition, the essence, types and a number of indicators of the administrative contract are discussed and analyzed, which are an important lever for the correct determination of the legal nature of the contract. And the fact that the issues of the possibility of crossing the sharp line of separation of public and private law and the formation of relevant criteria are actively discussed in scientific circles significantly indicates the relevance of the work.
