The Implementation of Sharia Law Through Indigenous Courts: A Study of Local Wisdom in Aceh from a Sharia Perspective

This study examines how violations of Islamic Sharia in Aceh can be resolved through Indigenous Courts. It aims to address the perceived ambiguity in handling such violations within Indigenous legal mechanisms. By establishing legal certainty, the implementation of Islamic Sharia can be conducted smoothly and comprehensively. This research employs a qualitative approach, incorporating legal and jurisprudential analysis. The findings indicate that the resolution of Islamic Sharia violations in Aceh is influenced by local customs, community traditions, and Islamic criminal law. Indigenous Courts play a significant role in maintaining legal credibility and addressing these violations in alignment with community norms. Furthermore, the study concludes that resolving Sharia violations through Indigenous Courts does not contradict Islamic principles as outlined in the Quran and Hadith. The involvement of the District Court, along with expert legal opinions, supports the legitimacy of these resolutions, ensuring that they align with the spirit and teachings of the Quran and the Sunnah while providing a structured framework for Sharia-based adjudication.
