Solutions to Ensure the Effectiveness of Criminal Liability Prosecution of Legal Entities

For the first time, criminal liability for legal entities was prescribed in the Criminal Code 2015 (amended in 2017), which came into effect on 01 January 2018. This is considered a big step in Vietnamese criminal legislation. However, this regulation has faced several challenges and limitations. In this article, by analyzing an adjudicated case, the author points out some limitations in the practical application of the Vietnamese Criminal Code regarding the criminal prosecution of a legal entity and proposes solutions to enhance the effectiveness of prosecuting procedure.
