REMARKS ON THE POLISH MODEL OF COURT GUARDIANSHIP, THE LEGAL STATUS OF THE GUARDIAN OFFICER AND THE NEED AND DIRECTIONS OF CHANGES IN THE LAW

The article addresses the very poorly developed in the literature issue of the Polish court probation model and the legal status of the probation officer. Its author points to the binarity of this model visible in the combination of family and adult probation into one service. In his opinion, this was quite risky, because their tasks are different. The article also points to the quite close connection between court probation and the common courts, and especially its subordination to the judicial authorities. A separate thread of considerations is the indication of the lack of a direct definition of the legal status of the probation officer. According to the author, his employer is the district court, and the probation officer is its employee. In conclusion, the author proposes separating the tasks of the family and adult probation officers in the act on court probation officers, as well as introducing a provision that they are officers of the court probation service.
