Bồi thường thiệt hại do hành vi xâm phạm sức khoẻ của “người” đã thành thai nhưng chưa được sinh ra
Medical examination, treatment, consumption of drugs, or accidents that a mother undergoes may create health damage to unborn child. Practice in various countries shows that the rights of people born later are given special attention by the Court. The law of Vietnam stipulates that some fetal rights are protected by the regulations conditionally, but it fails to deal with the damages to health created to the fetus directly. The article studies the issue from the aspects of (i) the acceptability of the right to claim compensation for damages; (ii) the subject of the claim; (iii) conditions giving rise to liability for damages.
