Family disputes: episteological and practical aspects during the period of martial state

The article analyzes family disputes, their causes, and their significance for developing balanced approaches to their resolution, especially in wartime conditions. The necessity of a comprehensive study of the determinants of family conflicts is substantiated, as it will contribute to the development of effective strategies and tactics for family policy aimed at reducing the level of conflict in society. The importance of eliminating or neutralizing the causes of disputes based on a targeted and consistent state policy, upbringing, strengthening family values, and fostering a culture of mutual respect in families is emphasized. Family disputes constitute a significant part of civil court practice and are characterized by a high level of emotional tension. The emotional nature of the parties’ arguments, their subjective perception of the conflict, and the uncertainty of legal positions complicate case resolution, distinguishing them from other categories of civil disputes. It is established that resolving such cases requires not only legal knowledge but also an understanding of the psychological aspects of interpersonal relationships. This necessitates enhancing judges’ competencies in family psychology to ensure more objective and effective justice. Attention is given to the impact of external and internal factors on the escalation of family conflicts. Among them, the weakening of spirituality, neglect of traditional family values, social and economic difficulties, shortcomings in family and educational upbringing, and prolonged separations of married couples during wartime are highlighted. It is proven that awareness of these factors and predicting their impact will contribute to stabilizing the institution of the family, reducing conflict levels in society, and fostering a healthy social environment. It is proposed to expand specialized judicial training by introducing programs on the fundamentals of family psychology. This will not only improve methods for resolving family disputes but also enhance the effectiveness of judicial proceedings, ensuring objective and impartial resolution of family conflicts.
