Typology of the principles of state regulation of the turnover of virtual assets
Virtual assets have become an important element of financial markets, but their legal status, regulation and integration into the economic system are subject to much debate. One of the key problems is the lack of a unified approach to regulating the circulation of virtual assets at the national and international levels. This causes legal uncertainty, which in turn creates risks for both market participants and the economy as a whole. In view of this, it is important to study the typology of the principles of state regulation of the circulation of virtual assets. The article analyzes the concept of «typology» and identifies its features. The approaches to understanding this term by individual scientists are considered. It has been determined that the allocation of a system of principles for the circulation of virtual assets is related to the specifics of the legal nature of virtual assets and the requirements for the functioning of entities that ensure their circulation. An approach is considered in which the system of principles for ensuring the circulation of virtual assets consists of: 1) general principles of the functioning of subjects of power; 2) special principles of the use of virtual assets in the public sector; 3) principles of the circulation of virtual assets. A group of principles enshrined in Article 14 of the Law of Ukraine «On Virtual Assets» has been identified, in particular: expediency, adequacy, efficiency, balance, predictability, transparency, and consideration of public opinion. The principles aimed at ensuring the state regulation of the segment of taxation of transactions with virtual assets are defined. It is noted that the positive effectiveness of state regulation of the turnover of virtual assets is not possible without the proper and effective functioning of the state financial control system, which is possible under the conditions of consistent implementation of certain principles in the activities of regulatory bodies. It is concluded that the analysis of typology and formation of a system of principles for the circulation of virtual assets as a set of starting points and fundamental principles is extremely important for further regulatory and state regulation of this area.
