Local self-government in St. Petersburg as a federal city: features of constitutional and legal consolidation and organisation
Introduction. Based on the analysis of federal and regional legislation the article shows the specifics of the implementation of local self-government in the subject of the Russian Federation – the federal city of St. Petersburg. The relevance of the research is determined by the persistence of problems in the organisation of the functioning of local self-government in the subjects of the Russian Federation in modern conditions and the inappropriate elaboration of this issue in modern legal literature. The object of the analysis is the signs characterising the features of local self-government in St. Petersburg in comparison with the features of local self-government in Moscow and Sevastopol. Methods. In the study of federal and regional legislation on the specifics of local selfgovernment in cities of federal significance – subjects of the Russian Federation, as well as the practice of their implementation, the following methods were used: systematic approach, formal-logical and formal-legal methods, the method of comparative jurisprudence. Results. Gaps in the legal regulation of local self-government in St. Petersburg have been identified and proposals have been made to eliminate them. It has been revealed that despite the requirement of Federal Law No. 131-FZ of October 6, 2003 on the presence of its name in the regulation of the municipal entity (a required condition for registration of the regulation), as a feature of the municipal districts of St. Petersburg is the absence of a name for 31 districts. It is concluded that the absence of the name of the municipality during the registration of its regulation indicates the lack of proper control by both the competent authorities registering the charters of municipalities and law enforcement agencies. The fact is noted that Article 41 of the Regulation of St. Petersburg devoted to the system of legal acts of this city of federal significance as a subject of the Russian Federation does not contain normative legal acts of local governments.
