Public danger and insignificance of evasion of administrative supervision
Introduction. The author’s objective is to analyse the key criteria of criminalisation of evasion of administrative supervision, as well as the characteristics of public danger of this act. The focus was on identifying indicators that can distinguish between a particular case of evasion of administrative supervision and minor acts. Methods. The present study was conducted using the scientific dialectical method of cognition of social phenomena. In addition, we used specific private-scientific techniques, including generalisation, analysis, synthesis, induction and deduction, taking into account the subject under consideration. Results. The author analyses the criteria of public danger and of criminalisation of evasion of administrative supervision, thereby identifying the main objective and subjective features. These features indicate the need for criminal-law protection of public relations regarding compliance with the legal regime of administrative supervision of persons released from places of deprivation of liberty. Considering the features that imply the potential for cases of evasion from administrative supervision to be regarded as insignificant acts, the author identifies a comprehensive set of circumstances. These circumstances cannot be considered by the court as features of insignificance. As a criterion of insignificance of evasion of administrative supervision, it is proposed to consider not one or two indicators, but a set of factors. Furthermore, the author does not propose that systematic unlawful behaviour on the part of the person under supervision should be considered as insignificant.
