Foreign Experience in Legal Regulation of Partnership Financing in the Banking Sector as a Form of Investment
This study examines international experience in the legal regulation of partnership financing in the banking sector, with an emphasis on its investment component. A comparative analysis of international regulatory models in the field of partnership financing, including public-private partnerships and joint investment institu-tions, is conducted. Based on empirical material from economically developed jurisdictions, regulatory mecha-nisms that ensure the sustainable development of partnership structures are studied. Significant legal aspects are considered, including mechanisms for risk sharing, enforcement of contractual obligations and protection of investors’ rights, as well as their impact on the banking sector. Particular attention is paid to the analysis of practical cases of successful implementation of partnership projects in various countries, which allows identify-ing key factors in the effectiveness of the regulatory approaches used. Proposals are formulated for the im-plementation of effective foreign practices in order to improve the mechanisms of partnership financing in the banking systems of various countries.
