ALÉM DO SIM E DO NÃO: Desafios teóricos para a compreensão da negociação, decisão e comunicação do consentimento sexual

In this article, we explore the multifaceted aspects of sexual consent, examining its foundations for theoretical study, emotional underpinnings, and practical dimensions from the perspective of negotiation. We highlight the critical importance of this topic, advocating for the recognition of the need for a comprehensive analysis that integrates emotional, cultural, and legal frameworks. This integrative approach is used to examine how discrepancies or misunderstandings in negotiating consent can precipitate incidents of sexual violence. We argue that understanding consent as a fundamental principle is essential for preventing sexual violence. Our analysis addresses the emergence of such violence, attributing it not only to prevailing power dynamics but also to deficiencies in the negotiation and articulation of consent. We discuss the influence of emotional responses in decision-making processes related to consent, emphasizing how these reactions can obscure communication and interpretation of intentions, thereby impacting consensual engagements. We propose that a deeper and more contextualized understanding is imperative to prevent misinterpretations and sexual violence, advocating for the development of policies and research that integrate broader aspects of consent.
